Important Changes for Consumer-Directed Attendant Hours

Effective June 30, 2016

  • Attendants will no longer be paid overtime for hours worked over 40. If a timesheet is submitted after June 30th for the pay period between January 1 and June 29, the attendant will be eligible for overtime and it will be paid accordingly. Remember, these changes apply to the dates of service, not the date the time sheet is submitted.

  • Attendants will only be paid up to 40 hours for one Employer of Record (EOR). Attendants are eligible to work up to 40 hours per week for each Employer of Record. Example: an attendant may work up to 40 hours for Employer A and up to 40 hours for Employer B.

  • Live-in Attendant Exception: This limit does not apply to attendants that live in the same home as the individual for whom the attendant provides service. Live-in attendants may work more than 40 hours a week because they are exempt from overtime pay. Live-in attendants should make sure that address information on file with PPL is accurate. You may verify this at https://fms.publicpartnerships.com/PPLPortal/login.aspx. EORs should work with their services facilitator to find out more about requirements when there is a live-in attendant.

These changes are tough for all of us who have loved ones who utilize more than 40 hours per week for their care. Please remember that these changes have nothing to do with their authorization of hours at all......your amount of hours will remain the same.
